Introduction

By accessing or using our Service, you agree to these Terms of Service (“Terms”). You must comply with any account verification requirements that apply to the features you use (including age verification for the DIY Generator and any other age restricted areas we designate). If you use the DIY Generator, you must maintain an active subscription and use our token system as described. DFY Services are purchased separately through our website and are not conditional on maintaining an in app subscription (except where you choose to use DFY Deliverables inside the DIY Generator). If you do not agree to, or fail to meet, these requirements (where applicable), you may not use the relevant parts of the Service.

Definitions

Service: The Creator Studio platform and all related websites, apps, tools, and features operated by The Creator Alliance Pty Ltd.

DIY Generator: The in app subscription based content generation features.

Done For You Services or DFY Services: Website ordered services where we create customised digital outputs based on information and materials you provide, including exclusive model creation, avatar or likeness creation, and product integration services.

Deliverables: The digital outputs we provide to you from DFY Services, delivered via email or your portal, and in some cases made available in app if you have an account.

User: Any person who accesses or uses the Service. To create an Account, access the DIY Generator, or place an order for DFY Services, you must be at least 18 years old (or the age of majority in your jurisdiction).

Account: A registered user profile in good standing on the Service.

Age Verification: The process used to confirm a user is an adult, through a third party verification service.

Subscription: The paid plan required to access core features of the DIY Generator.

Tokens: The virtual currency required to initiate content generation or use certain features, which has no value outside the Service.

Model: Any Creator Studio AI model or content pack made available in the Model Store.

Output: The AI generated result produced from a user’s prompt (e.g. an image or video).

Licence: The permission granted to a user to use Outputs under the terms set out in our AI Content Licence and Intellectual Property Policy.

Prohibited Conduct: Activities that breach these Terms, including attempts to bypass verification, subscription, or token requirements, reverse engineer the Service, or generate disallowed content.

Moderation: Our review and enforcement activities to uphold policies and law on the platform.

Repeat Infringer: A user who is the subject of multiple valid intellectual property infringement notices. 

User Eligibility & Account Verification

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an Account, access the DIY Generator, or place an order for DFY Services.

Age verification is required to access the DIY Generator and any other areas or features we designate as age restricted. DFY Services ordered through our website do not require you to complete age verification, but you must not place a DFY order if you are under 18, and you confirm your eligibility at checkout.

Account Creation & Age Verification

When creating an account, you are required to provide accurate personal information and verify your age/identity. We use a secure third-party verification service to confirm that you meet the minimum age requirement (18 or older, or the required age in your region). This may involve submitting a form of government-issued ID or undergoing biometric checks, as allowed by law. You consent to this verification process and to our receiving confirmation of your eligibility.

If you do not successfully complete age verification, you will be denied access to the DIY Generator and any other age restricted areas or features. You may still be able to access public website pages that are not designated as age restricted, and you may purchase DFY Services only if you are 18 or older.

We do not publicly disclose the name of our verification provider (to allow flexibility if the technology or provider changes); however, your data will be handled as described in our Privacy Policy. This step ensures that no minors can access age-restricted content on the platform.

Active Subscription Requirement

An active paid subscription is required to access and use the DIY Generator, including generating content in app and accessing any subscription restricted models and features. DFY Services are purchased separately and are not conditional on maintaining an in app subscription, although using certain DFY Deliverables inside the DIY Generator may require an active subscription. After creating your account and passing verification, you must select a subscription plan (e.g. monthly or annual) and provide valid payment information. Only users with a current paid subscription can purchase models from the Model Store or initiate content generation.

Subscription fees are billed according to the plan terms (for example, monthly in advance) and will auto-renew until cancelled, unless stated otherwise. You may cancel a subscription following the provided instructions, but fees are generally non-refundable once paid (except as required by law or explicitly stated in our refund policy). If your subscription lapses or is cancelled, your access to purchased models and the ability to generate new content may be suspended until you reactivate a subscription.

We reserve the right to offer promotional trials or free tiers at our discretion. However, any such offers still require full age verification and are governed by these Terms.

Token Purchase & Usage

In addition to maintaining an active subscription, generating content on the Service requires the use of virtual Tokens. Tokens are an in-app virtual currency that you must purchase (in packages or as needed) through our platform. Each content generation (or other specified action in the app) will deduct a certain number of Tokens from your account balance.

Tokens have no monetary value outside the Service, are non-transferable, and are non-refundable once purchased. Purchasing Tokens grants you a limited, non-refundable licence to use them within the app for content generation and related features. Tokens do not represent personal property and cannot be exchanged or redeemed for cash. Make sure you purchase enough Tokens for your intended use, as content generation will be unavailable if your Token balance is exhausted.

We may occasionally award bonus or promotional Tokens, which are subject to the same terms and conditions. The Token cost for each model or generation may vary and will be displayed in the app (we reserve the right to change Token pricing or the required amount for any feature at any time).

Any unused Tokens will remain in your account for your use as long as your account and subscription are active. However, Tokens may expire or be forfeited if required by law or if your account is terminated due to a violation of these Terms. If we ever discontinue the Token system or the Service, we will provide notice regarding any compensation or conversion of remaining Tokens, as appropriate.

Model Purchases and Usage

Users with an active subscription may purchase licenced AI models from our Model Store to generate content. “Purchasing” a model grants you a usage licence for that model within the Service – it does not convey ownership of the model itself. Models available in the store are either created by us or by our authorised partners or internal team, and they may represent fictional characters or real individuals who have given permission for their likeness.

All user-generated content must be created using the pre-approved models from the Model Store. Any attempt to circumvent this rule (for example, by providing images or data through unauthorised means to create a custom or unapproved model) is a violation of these Terms and will result in account termination.

When you purchase a model, you may be required to pay a fee (in Tokens or currency, as specified). Once purchased, you will have access to generate and save content with that model while your subscription remains active.

We make no guarantee that any particular model will remain available indefinitely, and we reserve the right to remove or alter models in the store at any time. If a model you purchased is removed, we will handle it in accordance with our policies (for example, we may offer a refund or replacement at our discretion).

User Content and Generated Content

All content you generate using the Service (e.g. images, videos, or other outputs) can be saved to your account. You agree to use generated content only for lawful purposes and in accordance with these Terms. Ownership and rights regarding generated content are governed by our Intellectual Property Policy and AI Content Licence. Your rights to use outputs are governed by the AI Content Licence & Intellectual Property Policy and any model specific terms. Where permitted, you may use outputs for personal and commercial purposes subject to those terms and applicable law.

Commercial use of Outputs is governed by the AI Content Licence and any Model Specific Terms. Unless Model Specific Terms state otherwise, commercial use is permitted in accordance with the AI Content Licence and applicable law. We (or model creators) may retain ownership of, or rights in, the underlying Models and platform technology, and may retain limited rights to use Outputs for platform operations, safety, research, and promotional purposes in anonymised or aggregated form, as described in the AI Content Licence, Model Specific Terms, and our Privacy Policy.

User Uploads: If the Service allows you to upload any content (for example, images of yourself or your products to incorporate into outputs), you retain ownership of your original content. However, by uploading, you give us permission to use and modify those uploads as needed to deliver the Service. This means we may process your images to create custom models or outputs for you. We will not use your uploaded content for any purpose outside of providing the Service (and enforcing our policies) without your consent. You are responsible for ensuring that anything you upload complies with our rules and that you have all necessary rights to it. Any content you upload must not infringe or violate the rights of others or any law. If you upload someone else’s personal data or likeness, you must have that person’s explicit consent. Misuse of uploaded content can lead to its removal and may result in account termination.

You are solely responsible for the content you generate and must ensure that it does not violate any laws or the rights of others (including intellectual property, privacy, or publicity rights).

Prohibited Conduct

We enforce strict acceptable use policies on the platform. By using the Service, you agree not to engage in any of the following prohibited activities:

Illegal or Harmful Content: Do not use the Service to create or share content that is illegal, obscene, harassing, defamatory, or that exploits or harms minors in any way. Do not use the Service to create or share content depicting real individuals without authorization. Any depiction of an actual minor is strictly forbidden (and will be reported to authorities). You may only create an image or video of a real adult if you have that person’s explicit permission and you use our officially supported tools to do so. (In practice, this means no “deepfakes” of any person without consent.) Creating content that infringes someone’s privacy, publicity, or intellectual property rights – for example, using a person’s image or a brand’s logo without permission – is strictly prohibited and may result in immediate termination.

No Bypassing Restrictions: Do not attempt to circumvent the account verification process, subscription requirements, or token system. For example, you must not create multiple accounts to bypass verification or obtain additional free trials, nor use any hacks or unauthorised methods to avoid paying subscription fees or using Tokens as intended. Any detected circumvention or fraud will result in immediate suspension of your account.

No Unauthorised Usage: Do not use automated scripts, bots, or reverse-engineering techniques to manipulate the Service or extract data. The Service’s models and content generation algorithms are proprietary. Any attempt to scrape, copy, or misuse them (including using the Service for competitive research or for training models outside the allowed use) is strictly prohibited.

Compliance with Model Licences: Adhere to any specific usage guidelines provided for certain models or content. For example, a model may restrict commercial use of its outputs or limit content to safe-for-work only. You agree to follow any such model-specific terms as communicated in the Model Store or in the model’s description. We reserve the right to monitor generated content for compliance, using automated filters or manual review. If we determine that any content you generated violates these Terms or applicable law, we may delete the content and take action on your account.

No Real Person Depictions: You must not attempt to generate, depict, or suggest that any Output represents a real, identifiable person unless you have that person’s explicit, verifiable consent and you use our authorised avatar or likeness process. This rule applies to depictions of public figures, celebrities, and private individuals. Any attempt to bypass this, including attempting to create an unapproved deepfake, is grounds for immediate account termination and possible referral to law enforcement authorities.

Payment and Refund Policy

All subscription payments and Token purchases are processed through our third party payment providers. By providing your payment information, you represent that you are authorised to use the chosen payment method, and you authorise us (or our payment processor) to charge applicable fees to that payment method. Prices are displayed in the currency shown at checkout and may include or exclude taxes depending on what is shown at checkout. Your bank may apply foreign exchange or other fees depending on your location and payment method.

No refunds will be provided for subscription fees or Tokens that have already been purchased and used, except as required under applicable consumer protection laws or as explicitly described in a promotion or specific refund policy. If you experience technical issues that prevent you from using services or Tokens you’ve purchased, you should contact customer support. At our discretion, we may provide remedies such as replacement Tokens or an extension of subscription time, but this is not guaranteed. We may offer refunds or cancellations in special cases in accordance with our separate Refund Policy, but generally all sales are final.

This no-refund policy applies to all purchases, including one-time in-app purchases such as model packs, exclusive/custom model creation services, or other digital add-ons. Once a digital product or service is delivered to your account, the sale is final (barring any rights under consumer law – see Refund Policy).

Custom Model Services & Delivery

Digital service delivery. Typical delivery is within 24 to 36 hours. During peak demand, delivery may take up to 48 hours. You will receive access or files via email or your portal. Delivery timeframes are estimates and may vary depending on demand and complexity.

Once your Deliverables are ready, we will notify you via email or within your portal. If a DFY Deliverable includes an exclusive model intended for use inside the DIY Generator, access to that in app use may require an active subscription. This does not affect your access to DFY Deliverables delivered via email or your portal, subject to reasonable access controls and retention practices.

Revisions: If the delivered DFY Deliverables materially deviate from the specifications you provided at purchase, you may contact us within 7 days to request a review. At our discretion, we will make reasonable adjustments to correct any clear errors or mismatches with your initial requirements. Major changes or new requests outside the original scope may require an additional purchase.

No Warranty for Subjective Satisfaction: Custom creative outputs are inherently subjective. Minor imperfections or stylistic differences do not constitute non delivery or breach of our obligations. The service is considered delivered in good faith if it substantially meets the description and any specifications agreed upon.

This section operates subject to applicable consumer laws, including Australian Consumer Law. In the event of a major failure (for example, if the custom service is not delivered at all), you may be entitled to a remedy. Otherwise, custom service fees are non refundable once the service is rendered, as the work is personalised and consumed upon delivery.

DFY uploads and permissions: If you submit images for avatar or likeness creation, you must be the person depicted or have explicit permission from the person depicted, and the person depicted must be an adult. You represent and warrant that you have obtained all necessary consents and releases from any person shown in the images (including privacy and publicity rights consents), and you will provide reasonable evidence of such consent if requested. If you submit product materials for product integration, you must have the rights and permissions necessary for us to use those materials (including any copyright and trademark permissions required) to create the requested outputs. You must not submit content involving minors, illegal content, or non consensual content, or any content that infringes another person’s rights. We may refuse, cancel, or restrict any DFY order that breaches these Terms, our policies, or applicable law. 

Privacy and Data Usage

You acknowledge that your personal information will be processed as necessary for account creation, verification, and provision of the Service, as detailed in our Privacy Policy. This processing includes the use of third-party services for identity verification and payment processing. We care about your privacy and handle your data in compliance with applicable data protection laws (see our Privacy Policy for more details).

User Responsibilities & Fictional Content

·       Abide by All Rules: By accessing Creator Studio, you agree to abide by all rules and guidelines outlined in these Terms of Service.

·       Fictional Content Only: Outputs are AI generated and fictional by default. Except where you upload images through an approved avatar or likeness process with explicit consent, you must not attempt to depict or impersonate identifiable real people. You must not request or distribute any non consensual content involving real individuals.

·       Use the Service Responsibly: You are responsible for your own actions on the platform. You must use our AI models and content generation tools legally and ethically at all times.

·       No Illegal Content: Do not use the platform to create or share illegal content. This includes any depiction of minors, non-consensual acts, or any other content outlawed in your jurisdiction. Such content is strictly prohibited by our policies.

·       No Service Misuse: Do not attempt to misuse the Service. For example, you must not try to identify or “reverse engineer” the AI models to find real individuals (none exist), and you must not attempt to upload your own content or data to the platform except through approved means (as our Terms forbid custom/unapproved content uploads).

·       Maintain Fantasy Boundaries: Remember that everything on Creator Studio is fantasy. Keep it separate from real life. The platform provides fictional scenarios and imagery; you are responsible for treating it as such and not using it to harm or defame others.

·       Age Restricted Access: Access to the DIY generator and any other areas we designate as age restricted is limited to verified adults. Done For You services purchased through our website require you to confirm you are 18 years or older, and we may refuse or cancel orders, or request additional information, if we reasonably suspect a request involves a minor or otherwise breaches our policies or applicable law.

·       Acknowledgment of Content: By using the Service, you acknowledge that you understand the content may be mature in nature. You agree to hold Creator Studio harmless for any personal reactions or consequences that result from your use of the platform, as long as we operate within the law and in accordance with these Terms.

·       Consequences of Violations: If you violate the Terms of Service – for example, by attempting to share content with minors, or engaging in harassment or other abusive behaviour – your account will be terminated.

In summary: Enjoy the fictional content responsibly, respect the rules, and understand your obligations while using Creator Studio.

Modifications and Termination

We reserve the right to modify these Terms or any features of the Service (including the verification process, subscription plans, token system, or model availability) at any time. If we make material changes, we will notify users through the app or via email. Your continued use of the Service after any changes to the Terms indicates your acceptance of the new terms.

We may terminate or suspend your account at any time if you violate these Terms, or for any security or compliance reasons. If your account is terminated for violating the Terms, you will lose access to the Service and forfeit any purchased models, remaining Tokens, or subscription time without refund. We also reserve the right to terminate the Service or any part of it entirely. If we discontinue the Service, we will provide notice and, at our discretion, may offer pro-rated refunds for any unused subscription period or unspent Tokens at that time.
