Introduction
This AI Content Licence & Intellectual Property Policy explains how Creator Studio manages rights in the content you create using our AI models. When you generate images, videos, or other media on our platform, you receive a licence to use that content under certain conditions. We grant you broad rights to use your AI-generated outputs for personal enjoyment and, in many cases, for commercial projects – but these rights come with important restrictions and responsibilities. This Policy clarifies what you can and cannot do with your AI-generated content, what rights we (and our partners) reserve, and how ownership and intellectual property issues are handled. Please read this document carefully, as it forms part of the legal terms governing your use of Creator Studio (in conjunction with our Terms of Service and other policies).
Definitions
For clarity, here are key definitions used in this Policy:
Licence – The permission to use Outputs on the terms in this Policy.
Personal Use – Use of Outputs for non-commercial purposes as permitted under this Policy.
Commercial Use – Any use of Outputs intended for monetary gain or business advantage.
Model – Any Creator Studio AI model or content pack used to generate Outputs.
Output – The AI-generated result produced from a user’s prompt (e.g. an image, video, or text).
Moral Rights – Has the meaning given under applicable intellectual property law (e.g. the rights of creators to attribution and integrity of their work).
Intellectual Property Rights – Rights in and to the Creator Studio service, including the AI models, algorithms, software, and branding.
Model Specific Terms – Any extra licence conditions that apply to a particular model or subscription tier (these will be communicated if applicable).
Ownership of Platform & Models
All underlying technology, algorithms, AI models, and platform materials on Creator Studio are the intellectual property of The Creator Alliance Pty Ltd or our licensors. Using our service does not transfer ownership of any AI model or software to you. When you “purchase” or unlock a model in Creator Studio, you gain a right to use that model within our platform – not ownership of the model itself. Creator Studio’s models are either created by us or provided by authorized partners, and they often represent fictional characters or themes. We do not allow users to upload or use external models or real-person likenesses on the platform (unless explicitly offered by us with that person’s permission; note that currently no model in our service is based on a real individual). Any attempt to bypass our model system – for example, by importing outside images to create new models, or reverse-engineering our models – is a violation of our terms and can lead to account termination.
In summary, Creator Studio retains all rights to the platform’s content generation system, AI models, code, and branding. You are granted a limited licence to use these tools as a subscriber, but you do not own the AI models or the technology behind your generated content.
Your Licence to Use AI-Generated Content
Whenever you generate content using Creator Studio, you are granted a personal, non-exclusive, non-transferable licence to view, download, and use that Output for any lawful purpose – including your own personal use and (subject to the conditions below) commercial use. In other words, the images, videos, or other media you create can be used in your personal projects and may also be used in commercial projects or monetised ventures by you. We acknowledge that you have an interest in the creative aspects of the Outputs you helped generate, and you retain whatever rights you may have in those creative elements. However, any use of your AI-generated content is subject to this Policy and our Terms of Service.
Commercial usage is allowed by default. You do not need additional permission from us to monetise or profit from the content you create, provided you comply with all the terms of this Policy and any applicable Model Specific Terms. “Commercial use” means any use intended for financial gain, business advantage, or public monetisation. This includes (but is not limited to):
Selling or licensing the AI-generated content to others (for example, selling prints of an image, or licensing a video clip for use in a project).
Using the content in advertisements, marketing, or promotional materials for a product or service.
Incorporating the content into merchandise, NFTs, prints, publications, or any product that is offered for sale or otherwise monetised.
Posting or sharing the content on revenue-generating platforms or channels, such as a monetised social media account, a YouTube channel with ads enabled, or a subscription-based site.
These activities are permitted without further approval, as part of your licence, as long as you adhere to this Policy.
In plain terms: You are free to use, sell, and commercialise the images, videos, and other Outputs you create with Creator Studio. However, with this freedom comes responsibility — you alone are responsible for how you use the content. For example, if you generate an image and use it commercially (say, in a product or advertisement), it’s up to you to ensure that this use does not violate anyone else’s rights or any laws. If someone claims that your AI-generated content infringes their copyright or trademark, or that it improperly uses their likeness, you will be responsible for addressing that issue. Creator Studio will not provide legal clearance for your specific use cases. If you are ever unsure whether your intended use is allowed or legally safe, please use caution and consider seeking advice or contacting us for clarification before proceeding.
Permitted Personal Uses
To avoid doubt, here are some examples of personal (non-commercial) use of your AI-generated content that are allowed:
Sharing Privately or on Personal Social Media: You may share your creations with friends or on your personal social media profiles, provided you are not charging anyone to view or access them. (Please also ensure that any platform where you share such content allows that type of content. For example, if your creation contains mature themes, make sure it’s on a platform or setting that permits it. You are responsible for obeying third-party platform rules.)
Personal Projects and Enjoyment: You can use the Outputs in your own creative projects that are not monetised. For instance, you might set a generated image as a wallpaper on your device, print a copy of an artwork to hang on your wall at home, or include generated content in a fan-fiction story or role-playing scenario that you share for free with a private group.
Profile Avatars or Icons: You may use an image you created as your avatar or profile picture on Creator Studio or other forums, as long as doing so doesn’t violate any rules (e.g. the image should not impersonate another person or contain disallowed imagery).
Modifying Outputs: You are allowed to edit, crop, or combine your AI-generated outputs however you like for personal or commercial purposes. (For example, you might use image editing software to touch up an AI-generated picture, or splice together AI clips in a video editor.) Keep in mind that editing the content doesn’t confer any new special rights if the end result is still substantially derived from the AI output. Any derivative work you create that is based on the AI output is still considered AI-generated content under this Policy, and the same usage restrictions and conditions apply to it.
Remember: In all cases (personal or commercial use), you must adhere to our Acceptable Use Policy and content guidelines. Do not use or share your AI creations in ways that violate our other rules – for example, you cannot post content that is prohibited (such as extreme violence, sexual exploitation, hate speech, etc., as defined in our content guidelines), and you must not create or distribute any non-consensual imagery. If you do choose to share content publicly (whether for personal enjoyment or commercially), we recommend that you clearly indicate it was AI-generated (for the sake of transparency and honesty). This is not a formal requirement, but being transparent about AI-generated content is considered good practice.
Platform’s Rights to Generated Content
Creator Studio and its model creators retain certain limited rights with respect to the content generated on our platform. Specifically, by using the service you acknowledge that we (and, where applicable, our model providers) may exercise the following rights over the outputs you generate:
Internal Use and Research: We may use the AI-generated content you create internally to operate and improve our services. For example, outputs might be reviewed by our team or algorithms to refine our models or to research and enhance the performance of the AI. Any such use of your content will respect our Privacy Policy and will not be shared publicly in a way that identifies you.
Promotional Uses (Anonymised): We reserve the right to use some of the content generated on Creator Studio for our own promotional or marketing purposes, but only in an anonymised or generic way. This means if we find an output particularly impressive and wish to showcase it (for example, on our website or social media to demonstrate what the AI can do), we would do so without revealing the content’s creator or any personal information without your consent. We will not claim your work as our own, but we might display it as an example of the platform’s capabilities.
Enforcement and Compliance: We may access, review, or use your generated content when needed to enforce our terms and policies or to comply with legal obligations. For instance, if there is a report or suspicion that a certain output violates the Acceptable Use Policy (e.g. contains prohibited material or infringes someone’s rights), our team may review that output. We might also use automated systems to scan outputs for signs of misuse. This is solely to ensure everyone’s safety and legal compliance on the platform.
No New Ownership of Your Inputs: We do not claim any ownership over the input you provide (such as the text prompts or any images you upload as references, if that feature exists) or over your resulting outputs beyond the limited rights outlined above. Apart from the specific internal rights just listed, you remain the holder of rights in your own creative input and we do not take control of or sell your unique outputs.
Outside of these limited rights, we do not use your private generated content for any other purposes without your consent. In short, you own your creative experience – we just maintain the platform and reserve these narrow rights to keep improving our service and to operate responsibly.
Intellectual Property and Rights of Others
While we give you broad licence to use your AI-generated content, it is crucial that you also respect the intellectual property and personal rights of others. You must use Creator Studio in a manner that does not infringe on others’ rights or break any laws. Key points include:
No Infringement of Copyrights or Trademarks
You are not allowed to intentionally infringe anyone’s copyright, trademark, or other intellectual property through the use of Creator Studio. This means you should not attempt to generate content that is an unlawful copy of someone else’s protected work (for example, recreating a famous piece of art or a brand’s logo with the intent to pass it off as your own or to avoid licensing). Even if our AI model produces something similar to existing copyrighted material by coincidence or due to its training data, you must be cautious in using that output. If the Output you obtain is substantially similar to someone else’s work, do not use it in a way that would violate the original owner’s rights. Ultimately, it is your responsibility to ensure that your use of any AI-generated content does not violate any copyright, trademark, or other IP laws. When in doubt about an output, either refrain from using it commercially or seek permission from the rights holder.
No Violation of Privacy or Publicity Rights (No “Deepfakes” of Real People)
You are strictly prohibited from using Creator Studio to create deepfakes or any depiction of real people without their consent. This includes both celebrities/public figures and private individuals. You must not generate content that portrays a real person in any manner that could violate their privacy or publicity rights. For example, you cannot create an image or video of someone without permission and use it as if they endorsed a product, nor can you place someone’s likeness in a false or defamatory scenario. Using someone’s image or identity in a way that misleads, defames, or commercially exploits them is not only against our policies but could also be illegal and violate that person’s rights. Always respect the dignity and rights of real individuals. In short, do not impersonate real people or imply anyone’s endorsement using AI-generated content unless you have their explicit permission to do so.
Third-Party Content in Outputs
Due to the nature of generative AI, some outputs might inadvertently include or resemble elements from third-party content (for example, fragments of existing artworks, recognizable characters, or trademarked designs that were present in the model’s training data). If any portion of your AI-generated content appears to contain material that might belong to someone else, you should approach its use with caution. As the user, you agree to take responsibility for reviewing the Outputs you wish to use, especially commercially or publicly. Do not assume that every Output is automatically clear of others’ content. If you identify any part of an Output that replicates or is heavily inspired by an existing copyrighted image, text, or trademarked graphic, you should not use or publish that portion without proper authorization from the rights holder. We also reserve the right to delete or block access to any generated content if we receive complaints or if we believe it contains unauthorized third-party content.
Your Agreement to Assume Liability
By using Creator Studio, you agree that you are solely responsible for any consequences of how you use your AI-generated content. If you choose to publish or commercialise an Output, you assume all liability for any claims, damages, or legal issues that arise from that use. The Creator Alliance (the operator of Creator Studio) is not responsible for policing how you use your outputs beyond our platform, and we will not indemnify you nor defend you in the event that your use of the content leads to a dispute or lawsuit. In practical terms, this means if a third party claims that your AI-generated content infringes their rights (or causes any harm), you agree that you will be responsible for handling it, including any legal fees or damages that may result. We provide the tool to create content, but once it’s in your hands, you are accountable for what you do with it. Make sure you comply with all aspects of this Policy and exercise good judgment, especially in commercial uses, to minimize any risks.
DMCA and Takedowns
We respect intellectual property laws and expect you to do the same. If a copyright owner believes that content generated on Creator Studio infringes their copyright, they (or their agent) may send us a takedown notice under the Digital Millennium Copyright Act (DMCA) or analogous laws. In accordance with our legal obligations, Creator Studio will respond to valid DMCA takedown requests. This can include removing or disabling access to the allegedly infringing content and, if applicable, notifying the user who created it about the action. If you receive a notice from us that content you generated was subject to a takedown, and you believe this was in error or that you have the right to use that content, you will have an opportunity to submit a counter-notification as described in our DMCA policy. Please note: We may also remove or block content preemptively if we have strong reason to believe it violates someone’s intellectual property rights, even before receiving a formal complaint. Additionally, be aware that repeat infringement can result in termination of your access to Creator Studio. We take rights violations seriously to ensure the platform remains safe and legal for all users.
Model-Specific Licence Terms
Some AI models or content packs on Creator Studio may come with additional licence terms or usage guidelines. For example, a particular model might be offered under a license that requires attribution, or a partner content pack might restrict commercial use of outputs. Any such Model Specific Terms will be clearly communicated (for instance, in the model description or at the time of selection). These specific terms will override or add to the default terms in this Policy for that particular model or content. Always review any model-specific notices — if a model has extra restrictions or permissions, you are required to abide by those conditions when using that model. In the absence of any model-specific terms, the general rules of this Policy apply.
Termination of Licence
The rights and licences granted to you under this Policy (including the permission for personal and commercial use of outputs) are contingent on your continued compliance with all applicable terms. If you misuse Creator Studio or violate this Policy or our Terms of Service, we may suspend or revoke your licence to use the AI-generated content. This means we could require you to stop using certain outputs, and we may also suspend or terminate your account. Serious or repeated violations – such as attempting to commercialise content in forbidden ways, harassing others with generated content, or engaging in illegal activities – can lead to a permanent ban from the platform and revocation of any rights to use content obtained through such misuse. We hope never to take these steps, but we will enforce our policies to protect our community, our partners, and the public.
