Introduction

This AI Content Licence & Intellectual Property Policy explains how Creator Studio manages rights in the content you create using our AI models. When you generate images, videos, or other media on our platform, you receive a licence to use that content under certain conditions, primarily for personal use. This Policy clarifies what you can and cannot do with your AI-generated outputs, what rights we and our partners reserve, and how ownership and intellectual property (IP) issues are handled. Please read this document carefully, as it forms part of the legal terms governing your use of Creator Studio (in conjunction with our Terms of Service and other policies).

Definitions

For clarity, here are key definitions related to this document.

·       Licence means the permission to use Outputs on the terms in this Policy

·       Personal Use means non commercial use permitted under this Policy

·       Commercial Use means use intended for monetary gain or business advantage, only when expressly authorised

·       Model means any Creator Studio AI model or content pack used to generate Outputs

·       Output means the AI generated result produced from a User prompt

·       Moral Rights has the meaning given under applicable intellectual property law

·       Intellectual Property Rights means rights in and to the Service, models, algorithms, software and branding

·       Model Specific Terms means any extra licence conditions that apply to a particular model or subscription tier

Ownership of Platform & Models

All underlying technology, algorithms, AI models, and platform materials on Creator Studio are the intellectual property of The Creator Alliance Pty Ltd or our licensors. Using our Service does not transfer ownership of any AI model or software to you. When you “purchase” or unlock a model in Creator Studio, you gain a right to use that model within our platform – not ownership of the model itself. Creator Studio’s models are either created by us or provided by authorised partners, and they often represent fictional characters or themes. We do not allow users to upload or use external models or real-person likenesses unless explicitly offered with that person’s permission (currently, no model in our Service is based on a real individual). Any attempt to bypass our model system (for example, by importing outside images to create new models, or reverse-engineering our models) is a violation of our terms and can lead to account termination.

In summary, Creator Studio retains all rights to the platform’s content generation system, AI models, code, and branding. You are granted a limited licence to use these tools as a subscriber, but you do not own the AI models or the technology behind your generated content.

Your Licence to Use AI-Generated Content

Personal Use Licence: Whenever you generate content using Creator Studio, you are granted a personal, non-exclusive, non-transferable licence to view, download, and use that output for your own lawful, non-commercial purposes. In other words, the images, videos or other media you create are for your personal use by default. You may save them to your account, share them privately with friends, or display them for your own enjoyment. We acknowledge that you have an interest in the creative aspects of the outputs you helped generate, and you retain whatever rights you may have in those creative elements. However, any use of your AI-generated content is subject to this Policy and our Terms of Service.

Unless expressly allowed by Creator Studio (for example, under a special program, specific model licence, or higher-tier subscription), you may not use the generated content for commercial purposes. “Commercial purposes” means any use that is intended for financial gain, business advantage, or public monetisation. This includes (but is not limited to):

  • Selling or licensing the AI-generated content to others.

  • Using the content in advertisements, marketing, or promotional materials for a product/service.

  • Incorporating the content into merchandise, NFTs, prints, videos, publications or any product that is offered for sale or monetised.

  • Posting the content on a revenue-generating website, platform, or channel (for example, on a paid subscription site or a monetised social media account).

In plain terms: you cannot sell, re-sell, or commercially exploit the images, videos or other outputs you obtain from Creator Studio without our prior written permission or an explicit licence agreement permitting it. The content is for you to enjoy personally. For example, you should not upload your AI-generated content to a commercial stock photo site, use it as part of a commercial game or comic you intend to sell, or print it on goods for sale, unless you have obtained a specific commercial licence from us. If you are unsure whether your intended use is allowed, please contact us for clarification before proceeding.

Permitted Personal Uses

To avoid doubt, here are some examples of what personal use of your AI-generated content can include:

  • Sharing Privately or on Personal Social Media: You may share your creations with friends or on your personal social media profiles, provided you are not charging for access. (Ensure that any platform where you share such content allows restricted content, if your creation contains mature themes. You are responsible for obeying third-party platform rules.)

  • Personal Projects and Enjoyment: You can use the outputs in your own creative projects that are not monetised – for instance, setting it as a device wallpaper, printing a copy for your wall at home, or incorporating it into a fan-fiction or role-play scenario for free enjoyment with a private group.

  • Profile Avatars or Icons: You may use an image you created as your avatar on Creator Studio or other forums, so long as it does not violate any rules (e.g. not impersonating someone or containing disallowed imagery).

  • Modifying for Personal Use: You are allowed to edit, crop, or combine your AI outputs for personal, non-commercial purposes. Editing the content doesn’t confer any new rights if the end result is still substantially derived from the AI output. All derivative works you create from the output are still considered AI-generated content under this Policy and the same usage restrictions apply.

Remember, even in personal use, you must adhere to our Acceptable Use Policy and content guidelines. Do not share your AI creations in a way that violates our other rules (for example, posting prohibited content or any non-consensual imagery). If you do share content publicly (non-commercially), we recommend you clearly indicate it is AI-generated (for transparency), but this is not a formal requirement.

Prohibited Uses (No Commercial Exploitation)

  • No Commercialisation Without Permission: You cannot commercially exploit AI-generated content from Creator Studio by default.

  • No Transfers or Sub-Licences: Your licence is personal to you.

  • Model and Tier Exceptions: If Creator Studio offers specific models, subscription tiers, or programs that do allow broader usage rights or commercial use, we will explicitly inform you.

  • No Impersonation or Unauthorised Endorsements: Even under personal use, you must not use AI outputs in a manner that suggests an endorsement by or association with real people or brands that you do not have permission for.

Platform’s Rights to Generated Content

Creator Studio and its model creators retain certain rights to generated content for:

  • Internal Use and Research

  • Promotional Uses (Anonymised)

  • Enforcement and Compliance

  • No New Ownership of Your Inputs

Outside of these limited rights, we do not use your private generated content for any other purposes without your consent.

Intellectual Property and Rights of Others

  • No Infringement of Copyrights or Trademarks

  • No Violation of Privacy or Publicity Rights: You are prohibited from using Creator Studio to create “deepfakes” or any depiction of real people without consent. This includes celebrities and private individuals. Using someone’s likeness in defamatory or false contexts is not only against our policies but could also violate that person’s rights.

  • Third-Party Content in Outputs

  • Your Agreement to Assume Liability

  • DMCA and Takedowns

Model-Specific Licence Terms

Some AI models or content packs on Creator Studio may come with additional licence terms or usage guidelines. These override or add to the default terms where applicable.

Termination of Licence

Your personal-use licence is contingent on your compliance. Misuse may result in revocation of your rights.
