Creator Studio is provided to you as is and as available, without any express or implied warranties. This means,

No Warranty of Performance or Availability: We do not guarantee that the service will be uninterrupted, timely, secure, or error free. There may be occasional outages, delays, or bugs, as with any online service or AI technology. You acknowledge that downtime or technical issues are possible, and you use the platform with this risk in mind.

No Guarantee of Results or Content: We make no promise that the content generated by our AI models will meet your expectations, be of any particular quality, or be suitable for a specific purpose. AI generated content can be unexpected, fictional, or inaccurate. We do not warrant the accuracy, completeness, or usefulness of any output from Creator Studio. The content is for entertainment or personal creative purposes and should not be relied upon as factual or as advice.

Disclaimer of Implied Warranties: To the extent allowed by law, we expressly disclaim all implied warranties or conditions that are not expressly stated in our Terms or policies. This includes but is not limited to disclaimed warranties of merchantability, fitness for a particular purpose, title, non infringement, and any warranties arising from course of dealing or usage of trade. In jurisdictions that do not allow the exclusion of certain warranties, we limit the duration of such warranties to the minimum period permitted by law.

No Warranty of Content Safety: While we enforce content guidelines and use moderation tools, we do not guarantee that all content you encounter will be safe, lawful, or not offensive to you. You might be exposed to fictional, age restricted content that could be disturbing to some viewers. By using a service that includes mature themes in restricted areas, you assume this risk. We provide content filters and rules, but the nature of AI means there is always some possibility of errant or undesired content. We are not responsible for any emotional distress or unwanted exposure you may experience from using the platform, except where the law imposes a duty. We comply with all content laws to prevent unlawful material.

No Professional Advice: Any information or content, for example messages or role play scenarios generated by the AI, must not be taken as professional advice, medical, legal, financial, or otherwise. Creator Studio is not intended to provide professional guidance. Always seek a qualified professional’s advice if you need it. We are not liable for any actions you take or fail to take based on information obtained through our service.

User Responsibility for Use of the Service

When you use Creator Studio, you agree that you are responsible for your own actions and decisions on the platform,

Fictional Content, Real Repercussions: All content on Creator Studio is fictional and computer generated for creative use. You agree to treat it as fiction. If you choose to share, use, or act upon any content from the platform in real life, you do so at your own risk. Creator Studio will not be liable for any harm, offence, or damages resulting from your real world use of or reactions to the fictional content.

Compliance with Laws and Terms: You are responsible for using the service legally and in accordance with our Terms of Service and policies. If you use Creator Studio to create content that is unlawful or violates someone’s rights, for example harassing someone, creating defamatory or infringing content, or attempting to generate prohibited imagery, you are solely liable for the outcomes. We prohibit misuse of the service, and if you engage in it, any legal consequences or claims will fall on you, not on Creator Studio. By using our platform, you agree that you will not hold us responsible for any claims arising from your misconduct or unlawful use of the service.

No Liability for User Interactions: Creator Studio is not a social network. If you interact with others outside our service environment, or if you share your content externally, we are not responsible for those interactions. Any disputes or issues between you and third parties, including other users, are strictly between you and them.

Indemnification: You agree to indemnify and hold harmless Creator Studio and The Creator Alliance Pty Ltd, including our officers, employees, and affiliates, from any claims, losses, liabilities, or expenses, including legal fees, that arise out of your breach of the Terms or your misuse of the service. If your actions, or content you generate, cause a legal dispute or damage, and someone or a government authority pursues action against us as a result, you will compensate us for the cost and responsibility of that claim. This indemnity applies to the fullest extent permitted by law.

Limitation of Liability

Even if something goes wrong with the service, our liability is limited. To the maximum extent permitted by law, The Creator Alliance Pty Ltd, the provider of Creator Studio, and its affiliates, employees, agents, or partners will not be liable for,

Types of Damages Excluded: We will not be responsible for any indirect, incidental, special, consequential, or punitive damages. This includes for example damages for lost profits or revenues, loss of data, for example if some of your saved content is lost due to a technical issue, loss of opportunity or business, or personal injuries or emotional distress arising from use of the service or content. You consent to use a service that may involve sensitive material in restricted areas. By consenting to use it, you accept that we are not liable for how it might affect you emotionally or psychologically, aside from any obligations under law.

No Liability for Certain Losses: We are not liable for any damage to your computer, device, or other property that results from your use of the service, for example if downloading a file causes a problem with your device, which is unlikely, but we still disclaim responsibility for device issues within the bounds of law. We are also not liable for any third party conduct, such as the behaviour of other users or third party services, for example our payment processor or verification provider. Each of those parties is responsible for their own actions under their own terms.

Cap on Liability: If, notwithstanding the above disclaimers, we are found to be liable to you for any claim arising out of or related to your use of Creator Studio or these terms, our aggregate liability, together with our affiliates and personnel, will be limited to the amount you paid us in the past twelve months, if you have paid for a subscription or tokens. If you have not made any payments, our total liability to you will not exceed a nominal amount, for example AUD 50. This limitation applies to any and all claims, whether based on warranty, contract, statute, tort including negligence, or any other legal theory, even if we have been advised of the possibility of such damages or liability exceeding this amount.

Australian Consumer Law Notice: You may have statutory rights under the Australian Consumer Law or other consumer protection laws that cannot be excluded. Nothing in this policy is intended to exclude, restrict, or modify any right or remedy you have under such laws. For instance, under Australian Consumer Law, in relation to services supplied, in some cases you may be entitled to a re supply of the services or a refund if there is a major failure. To the extent we are permitted to limit our liability for a breach of any non excludable condition or warranty, for example to either resupplying the service or paying the cost of doing so, we will do so. If a court of law determines that certain liabilities or obligations cannot be limited or excluded by us, then those specific liabilities will be borne by us as required by law.

Jurisdictional Differences: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, for example not allowing limitation of liability for personal injury caused by negligence. In such jurisdictions, our liability will be limited to the greatest extent permitted by law. · You may receive content that is unpredictable or that you find undesirable

· You understand that any content you create is fictional and you will not use it in harmful or unlawful ways

· You agree that the responsibility for any outcomes that result from your use of the platform lies with you, except where we are legally required to accept responsibility

· You recognise that technology is imperfect and that issues like outages, data loss, or AI mistakes, for example generating something inaccurate or inappropriate, can occur, and you will not seek to hold us liable for those inherent characteristics of the service

FAQ, Disclaimers and Liability

Q, What does it mean that the service is provided as is

A, As is means that we are providing you the service in its current state, with all its possible imperfections, and we are not giving any guarantees beyond what we explicitly promise in our Terms. There might be bugs, downtime, or content that is not perfect. We do, of course, put a lot of effort into making Creator Studio reliable and enjoyable.

Q, If the AI outputs something offensive or harmful, is Creator Studio responsible

A, Generally, no. We provide tools and have policies to prevent misuse, but the actual content is largely driven by user inputs and complex model behaviour. If the AI produces something that you find offensive or that could be harmful, we advise you to delete it and report it if it violates our guidelines. We are not liable for content that you or others generate, since the platform is user driven, subject to any non excludable rights under law.

Q, Are you saying you have zero responsibility no matter what

A, No. We are not attempting to exclude everything. We are not allowed to contract out of certain responsibilities under law, including consumer protection or negligence leading to personal injury. Within the bounds of the law, we limit our responsibility for ordinary issues like lost data, dissatisfaction with content, or financial losses from using the service. If we fail to meet a non excludable consumer guarantee, the remedies set out under law will apply.

Q, If I sue you, is the most I can get back just what I paid for the service

A, In almost all cases, yes. Our liability cap is generally the amount you paid us in the last twelve months, or a small nominal amount if you paid nothing, to the extent the law allows. If the law says a certain type of damage cannot be limited, then that specific limit would not apply, but the rest of the limitations would still hold.

Q, I am a consumer in Australia or another country, do these disclaimers remove my consumer rights

A, No. Your consumer rights under laws like the Australian Consumer Law are preserved. You still have the right to services that are provided with due care and skill. What this policy does is clarify that aside from those non excludable rights, we are not making additional promises. If we fail to meet a consumer guarantee and it is a major failure, you may have a right to a remedy. This policy does not override that.

Q, Why do I have to assume responsibility for content I create

A, Because you are the one directing the AI and deciding what to do with the outputs. Creator Studio provides the tools, but you decide how to use them. If you create inappropriate or unlawful material, that decision and use is yours, not ours. If you post content elsewhere and it infringes rights or violates that site’s rules, responsibility remains with you.

Q, What should I do if I believe Creator Studio caused me harm or loss

A, Contact our support team with details. We will assess the issue case by case. Ordinary issues may be addressed by standard remedies, for example a service credit, and consumer law remedies will be honoured where required. Keep in mind the limitations described in this policy. You can also seek independent legal advice if you wish.
