Definitions
For clarity, here are key definitions related to this document.
· DMCA means the United States Digital Millennium Copyright Act
· Designated Agent means our contact for copyright notices
· Takedown Notice means a request by a copyright owner to remove or disable access to allegedly infringing material
· Counter Notice means a response from a user whose material was removed that requests restoration of the material
· Repeat Infringer means a user who is the subject of multiple valid infringement notices, who may have their account terminated
· Compliance Checklist means our internal list that maps legal and platform requirements to the documents and controls that satisfy them
· Document Suite means the Terms of Service, Privacy Policy, User Safety and Content Moderation Policy, Refund Policy, Generative AI Usage and Responsible Use Policy, AI Content Licence and Intellectual Property Policy, and this DMCA template and checklist
Submitting a DMCA Takedown Notice
If you believe that content on Creator Studio infringes your copyright, you, as the copyright owner or an authorised agent, may submit a DMCA Takedown Notice to our designated agent at admin@creatoralliancegroup.com. Your notice should include the following, in accordance with United States DMCA requirements,
· Identification of the copyrighted work claimed to be infringed. If multiple works are involved, you can provide a representative list of those works
· Identification of the allegedly infringing material on Creator Studio, including specific URLs or content IDs to help us locate the material
· Your contact information, include your full name, mailing address, telephone number, and email address
· A statement of good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
· A statement of authority and accuracy, that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf
· Your signature, a physical signature or electronic signature, simply typing your full legal name at the end of the notice is acceptable
Please send the complete notice to admin@creatoralliancegroup.com. Once we receive a valid DMCA notice, we will promptly remove or disable access to the accused content and notify the user who posted it. Creator Studio’s policy prohibits users from posting content that violates others’ intellectual property rights, and we will take action in line with that policy.
Submitting a Counter Notice
If you are a Creator Studio user whose content was taken down due to a DMCA notice and you believe the removal was mistaken or due to misidentification, you may submit a counter notice to the same email address. A valid counter notice should include,
· Your name, address, and telephone number
· Identification of the content that was removed, including the location or URL where it appeared before removal
· A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
· A statement consenting to the jurisdiction of United States federal court in the district of your address, or any jurisdiction in which we may be found if you reside outside the United States, and that you will accept service of process from the original complainant
· Your signature, physical or electronic
Upon receiving a valid counter notice, we will forward it to the original complainant. If the complainant does not inform us within ten business days that they have filed a court action to restrain the allegedly infringing activity, we may restore the removed content. Creator Studio maintains a policy to terminate accounts of repeat infringers to remain in compliance with the DMCA. This process ensures that our platform, including areas that are available only to verified adults, adheres to United States DMCA standards for protecting copyrights while respecting our fictional content framework.
